No one seems to be concerned: Immigration attorney asks companies to reach out to Congressmen on H-1B visa stamping delay in India

Immigration attorney Emily Neumann said companies should approach their Congressmen, Senators and inform them about the H-1B visa stamping delay in India affecting their businesses.

Immigration attorney Emily Neumann said the current visa stamping delay situation in India has no possible solution, as no one seems to be bothered, as thousands of H-1B visa holders are stranded in India. The companies, Neumann said, should reach out to their Congressmen, urging them to find a solution to the situation as businesses in America are being affected“I don’t see anyone urging the Department of State to improve the situation. Typically, we would hear from members of Congress, urging the Department of State, ‘hey we need to open up more visa appointments as this is hurting business, this is hurting people’s ability to travel’ and I am not hearing anything about that right now. There does not seem to be any kind of concern, which tells me that they are not planning to improve anything. Because no one seems to be overly worried about it,” Neumann said. Companies should reach out to their Congressmen and Senators, letting them know the situation, impacting their business, their employees, the attorney said. “Until someone complains about it, there does not seem to be any motivation for the department to do anything,” Neumann said, adding that only the State Department and Secretary Marco Rubio can do anything about this. Donald Trump administration can’t put legal restrictions on H-1B, and this is Donald Trump’s way to impede the H-1B visa holders, immigration attorney Rahul Reddy said. He said the Trump administration learned from their past mistakes and now they know they can do a lot more when visa holders are outside the US and not inside the US and hence they advise visa holders against traveling outside the US. Currently, there is no interview date available in four consulates inside India, and the earliest date of appointment is around March 2027. This situation stemmed from the department’s mass rescheduling of interview dates in December 2025 because of social media vetting of H-1B and H-4 visa holders. As hundreds of Indians traveled to India during November, December and also scheduled their appointments at the embassy for new visa stamping during that time, they got stuck in India as they could not re-enter the US. Some companies allowed them to work from India but the overall situation is in limbo.
